[ARCHIVED] Notice of Intent to Request Release of Funds

On or about May 29, the City of Stevens Point will submit a request to the Wis. Dept. of Administration - Division of Housing for the release of Community Development Block Grant funds under Title 1 of the Housing and Community Development Act of 1974.

May 18, 2012

On or about May 29, 2012 the City of Stevens Point will submit a request to the Wisconsin Department of Administration – Division of Housing for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as Community Development Block Grant – Small Cities Housing Program, for the purpose of rehabilitating housing and providing homebuyer assistance in the City of Stevens Point, with the estimated funding amount of $550,000.00.

The activities proposed are categorically excluded under HUD regulations at 24 CFR part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at 1515 Strongs Ave, Stevens Point and may be examined or copied Monday-Friday, 7:30 am-4:00 pm.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to CAP Services, Inc., 1725 W River Drive, Stevens Point, WI 54481. All comments received by May 29, 2012 will be considered by the City of Stevens Point prior to submission of a request for release of funds.

RELEASE OF FUNDS

The City of Stevens Point certifies to the Wisconsin Department of Administration – Division of Housing that Andrew Halverson in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s acceptance of the certification satisfies its responsibilities under NEPA and allows the City of Stevens Point to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

The State of Wisconsin, Department of Administration – Division of Housing will accept objections to its release of funds and the City of Stevens Point’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if it is on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Stevens Point; (b) the City of Stevens Point has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State of Wisconsin; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.

Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to Wisconsin Department of Administration – Division of Housing at P.O. Box 7970, Madison, WI 53707-7970. Objections to the release of funds on any basis other than those stated above will not be considered by the Wisconsin Department of Administration – Division of Housing. Objections received after June 13, 2012 will not be considered by the Wisconsin Department of Administration – Division of Housing.
