Special Conditions of Supervision (Federal Supervision expires March 2007, State supervision expires in 2024)

  • Not own, possess or operate a personal computer system or device allowing access to the internet without written approval of the supervising U.S. probation officer and not seek employment or volunteer work that allows or requires internet access unless specifically approved by the supervising U.S. probation officer;
  • Not own, possess or operate any video or still camera. Defendant may not distribute any photographic depictions already in his possession.
  • Not possess or experience any pornographic or sexually explicit or stimulating material, in any form, including audiotapes, videotapes, photographs, or printed materials, and not maintain a post office box that would enable him to receive prohibited materials undetected;
  • Not leave the confines of the county or counties of employment or volunteer work and residence without approval of the supervising U.S. probation officer;
  • Not have any written, verbal, or physical contact with any children under the age of 18 and shall not visit places where children congregate (e.g., schools, daycare centers, playgrounds, parks, beaches, pools, shopping malls, theaters, festivals) without prior approval from the supervision U.S. probation officer. The defendant shall report all occasions when he had incidental contact with a child during routine daily travel (e.g., shopping, church).
  • Register with local law enforcement authorities, the state attorney general, and the state's sex offender registry as directed by the supervising U.S. probation officer. The supervising U.S. probation officer has the discretion to notify schools and recreational facilities in Miller's community of his conviction, his presence in the community and his release conditions.
  • Allow searches by the supervising U.S. probation officer of any residence or property under his control where there is reason to believe he is in possession of pornography or sexually explicit or stimulating material, personal computers, internet access devices, video cameras, still cameras, or other contraband and permit confiscation of any contraband materials;
  • Participate, at his own expense, in an outpatient mental health counseling program specifically designed to treat sex offenders, which may include the use of periodic polygraph examinations. The results of those examinations will not be used as evidence in any criminal prosecution or supervision revocation proceedings, but they will be used to determine the appropriate course of treatment as grounds for modification of release conditions, as a starting point for investigation of new criminal conduct, or for all of these purposes.
